Agreement to Terms
By creating an account or using LogStead (“the Service”), you agree to these Terms of Service. LogStead is operated by Elite Tech Global, LLC. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these terms.
Description of Service
LogStead is a web-based platform that helps employers manage OSHA injury and illness recordkeeping. The Service provides tools for logging workplace incidents, determining recordability under 29 CFR 1904, generating OSHA Forms 300, 300A, and 301, calculating DART and TRIR rates, and producing export files for electronic submission via OSHA's Injury Tracking Application (ITA).
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it up to date. Each user should have their own individual account; sharing login credentials is not permitted.
Free Trial and Subscriptions
New accounts receive a 14-day free trial with full access to features available on your selected plan. No credit card is required to start a trial. After the trial period ends, you must subscribe to a paid plan to continue creating and editing records. Existing data remains accessible in read-only mode if your trial expires or your subscription lapses.
Subscriptions are billed monthly through our payment processor, Lemon Squeezy. You may cancel your subscription at any time through the billing settings page. Upon cancellation, your access continues through the end of the current billing period, after which your account converts to read-only mode.
Because you receive a 14-day free trial before any charge, we generally do not offer refunds. If you believe you were charged in error or experience a significant service issue, contact us at support@logstead.app within 14 days of the charge and we will review your request on a case-by-case basis.
Your Data
You retain ownership of all data you enter into LogStead, including incident records, employee information, and establishment details. We do not claim any intellectual property rights over your content. You can export your data at any time via the PDF and CSV export features, and you can request a full data export by contacting us.
You are responsible for the accuracy and completeness of the data you enter. LogStead generates forms and calculations based on the information you provide; the accuracy of those outputs depends on the accuracy of your inputs.
Acceptable Use
You agree not to use the Service to store data unrelated to workplace safety recordkeeping; to attempt to access another organization's data; to reverse engineer, decompile, or attempt to extract the source code of the Service; to use automated tools to scrape or collect data from the Service; or to transmit any malicious code, viruses, or other harmful material.
Not Legal or Compliance Advice
LogStead is a recordkeeping tool, not a law firm or compliance consultancy. While the Service is designed to align with OSHA's recordkeeping requirements under 29 CFR 1904, we do not guarantee that using LogStead will make you fully compliant with all applicable federal, state, or local safety regulations. The recordability determinations provided by the wizard are based on general OSHA criteria and should not be treated as legal advice. You should consult with a qualified safety professional or attorney for specific compliance questions.
Limitation of Liability
To the maximum extent permitted by law, Elite Tech Global, LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, without limitation, any OSHA fines, penalties, or enforcement actions that may result from inaccurate or incomplete recordkeeping, whether or not the Service was used in preparing those records.
Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
Service Availability
We aim to keep LogStead available at all times but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.
Termination
You may close your account at any time by contacting us. We may suspend or terminate your access if you violate these terms, fail to pay subscription fees after reasonable notice, or if we are required to do so by law. Upon termination, your data will be retained for 30 days to allow you to export it, after which it will be permanently deleted.
Changes to These Terms
We may modify these terms at any time. If we make material changes, we will provide at least 30 days' notice via email or an in-app notification before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved in the state or federal courts located in Salt Lake County, Utah.
